We were engaged to provide specialist planning advice following the refusal of an application for retrospective permission for the expansion of an existing restaurant business to provide takeaways. The Council had refused this application due to concerns over the impact upon high safety from the potential for uncontrolled parking on the main road outside of the site.

Having examined the refusal we submitted an appeal citing the availability of off-street parking in the area, the brief nature of visits to the site, and the potential for multi-purpose visits to the area. Having considered the evidence put forward the Inspector considered that there would be no effect upon the safe operation of the highway as a result of the proposal and the appeal was allowed.
