We were approached by our clients agent to assess the refusal of an innovative, high quality, environmentally friendly development of 5 dwellings, including two affordable dwelling, on a site allocated for development within the village Llanferres. Having assessed the grounds for refusal, which centred on objections to the appropriateness of the design, impact upon highway safety, and loss of a green space within the village, we advised that an appeal against the decision would be the best route to take.

Submission of a detailed case examining the stance taken by the Council in refusing the appeal, and setting this against the high quality of the proposal brought forward, the allocation of the site for housing development within the adopted plan, and the benefits to the community, resulted in the appeal being allowed. An award of costs was also made against the Council for our client, as we were able to demonstrate that the Council had acted unreasonably in refusing the proposal without proper justification of their decision.
